1. Scope
These Terms of Service govern the purchase and use of the digital product “Daedalus Fleet” (the “Game”), offered by Monib Asad Masud, c/o maexware solutions GmbH, Freiburg im Breisgau, Germany (“Provider”). By placing an order, you agree to these terms.
2. Subject Matter
The Provider grants you a non-exclusive, non-transferable, personal license to download and use the Game on desktop computers (Windows, Linux) for private, non-commercial purposes. The Game is delivered as a digital download.
3. Contract Formation
The product presentation on this website constitutes a non-binding invitation. A binding contract is formed when you click the “Zahlungspflichtig bestellen” (“Order with obligation to pay”) button and complete the payment process.
4. Prices and Payment
All prices are final prices including the applicable value-added tax (VAT). Payment is processed via Stripe. No additional shipping costs apply (digital download).
5. Delivery
After successful payment, you will receive an email with a download link. The link is valid for 48 hours and permits up to 5 downloads. Additional download links can be requested via email.
6. License and Usage Rights
The license granted is for personal use only. You may install the Game on multiple devices you own. You may not: redistribute, sublicense, reverse-engineer, or modify the Game, nor use it for commercial purposes without prior written consent.
7. Warranty for Digital Products (§327 BGB)
The Game must conform to the agreed-upon quality at the time of delivery. If a defect exists at the time of delivery, you may demand rectification within 2 years (limitation period per §327j BGB). The Provider will provide updates necessary to maintain the contractual conformity of the Game for a period of 12 months from purchase (§327f BGB).
8. Liability
The Provider is liable without limitation for intent and gross negligence. For slight negligence, liability is limited to foreseeable, typical damage and only for breach of material contractual obligations. Liability for damage to life, body, or health remains unaffected.
9. Final Provisions
German law applies. If you are a consumer within the EU, mandatory consumer protection provisions of your country of residence also apply. Should any provision be invalid, the remaining provisions shall remain in effect. The European Commission provides a platform for online dispute resolution. We are not obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
